HOST REGISTRATION TERMS & CONDITIONS
This agreement applies to any individual, agent, or entity registering, submitting, or listing a property and its associated media assets with the Agent.
1. DEFINITIONS AND INTERPRETATIONS
In these terms and conditions:
"Agent or We" means A Beautiful Place To Get Lost LTD or their appointed representative.
"Owner" denotes the entity representing the property, site, land, or building available for hire.
"Submitter or Lister" denotes any individual, agent, representative, or entity registering, submitting, or listing a property, location, or associated media assets on the Agent's library or website.
"Location" signifies the site, property, land, or building to be listed.
"Contract" represents the agreement formed between the Owner/Submitter and the Agent, which includes these terms and conditions.
"Party" refers to the Agent, Owner, or Submitter, and "Parties" accordingly.
2. REGISTRATION & MEDIA SUBMISSIONS
2.1 By registering, submitting, or listing a property on our library—including the provision of media assets via direct upload or shared drive links—the Submitter/Owner agrees to be fully bound by these terms.
2.2 Media Ownership & Warranty: The Submitter explicitly warrants and guarantees that they are the legal copyright holder of all provided media assets, or that they possess unconditional, written permission from the photographer allowing commercial use, agency promotion, and digital listing.
2.3 Absolute Copyright Indemnity: The Submitter/Owner unconditionally indemnifies the Agent against any and all third-party copyright or intellectual property claims, legal proceedings, settlements, and expenses brought against the Agent arising directly out of or in connection with the imagery, links, or media assets provided for the listing.
2.4 Accuracy of Representation & Penalties: It is the sole responsibility of the Owner/Submitter to immediately notify the Agent in writing of any structural, layout, aesthetic, or interior changes to the property, and to provide updated imagery ensuring an accurate representation of the location. Any deviations between the website listing and the physical reality of the space that result in reasonable Client complaints or shoot disruptions may result in financial payment penalties, fee deductions, or the withholding of the booking payout to cover Client compensation.
2.5 Anti-Circumvention: To protect the Agent's curation and platform, the Owner agrees not to accept direct bookings or inquiries from any Client initially introduced to the property via the Agent's library. If an Owner circumvents the Agent to book directly with an introduced Client, the Agent reserves the right to invoice the Owner for the full standard 20% commission fee that would have been due.
2.6 Custom Clauses: It is the Submitter/Owner's sole responsibility to notify the Agent in writing at the time of registration if any specific property rules require custom additions to future booking contracts.
3. FEES, DEDUCTIONS & CANCELLATIONS
3.1 Location Library Joining Fee: Unless otherwise stated and agreed in writing, there is a one-time £150 admin fee which is deducted from your first hire fee to cover your photography review and edits, SEO setup, and digital listing. We then work on a standard 20% commission basis for bookings, unless a different deduction rate has been explicitly agreed upon prior to listing.
3.2 Commission Deduction: A BEAUTIFUL PLACE TO GET LOST LTD deducts a 20% commission from total earnings of all bookings, subject to any alternate promotional rates or custom deductions agreed in writing.
3.3 Owner VAT Declaration & Responsibility: The Owner must explicitly state whether they are VAT registered or not at the time of registration. Because the Agent does not currently charge VAT on its services, if an Owner fails to declare their VAT registration status prior to a booking confirmation, any subsequent payout or agreed hire fee will be treated as fully inclusive of VAT, and any unexpected VAT charges must be entirely covered by the Location.
3.4 Owner Invoicing: Location Owners must invoice the Agent the agreed hire fee to receive payment for the location hire. Any delays in sending the invoice will result in a delay in payment.
3.5 Compensation for Cancellations: The owner agrees that in the event of a cancellation unless they can prove with evidence that they would have had another booking on that day and the cancellation caused them to miss out on that booking, the agent will retain the full fee as compensation for the work performed. If the owner can demonstrate a loss of earnings due to the cancelled booking, they may be compensated for 50% of the hire fee upon mutual agreement.
3.6 Events Referral Fee: Event Locations must provide their own contract. The Agent will handle negotiations until contract signing. A Beautiful Place To Get Lost event referral fee is 10% of the total net spend and will be invoiced the day after the event takes place.
4. PROPERTY DAMAGE DISCLAIMER
The Agent acts solely as an introductory listing platform and intermediary. The Agent accepts no liability or financial responsibility for any physical damage, loss, or theft caused to the Location or its contents by a Client, production crew, or their attendees during a hire period. All claims for damage must be pursued directly against the Client's mandatory insurance policies.
5. LAW AND JURISDICTION
This agreement is governed by English law and subject to the exclusive jurisdiction of the English and Welsh courts.
SHOOT & EVENT AGREEMENT
1. DEFINITIONS AND INTERPRETATIONS
In these terms and conditions:
"Agent or We" means A Beautiful Place To Get Lost LTD or their appointed representative.
"Client" refers to the entity or individual, including but not limited to owners, companies, or third parties, that has agreed to lease a location, property, or land and uses the services provided by the Agent.
"Owner" denotes the entity representing the property, site, land, or building available for hire.
"Location" signifies the site, property, land, or building to be leased by the Client.
"Input Material" encompasses documents, materials, data, or any other information, whether written or verbal, provided by the Client related to the location hire.
"Contract" represents the agreement formed between the Owner and the Client, which includes these terms and conditions.
"Shoot" & “Event” signifies the use of a location by the Client for filming, photography, or other events.
"Party" refers to the Agent, Owner, or the Client, and "Parties" accordingly.
"VAT" stands for value-added tax.
2. INVOICES, PAYMENT & CANCELLATIONS
2.1 The Client must pay the Agent's Standard Charges and any additional agreed sums for the hire of the Location. These charges do not currently include Value Added Tax (VAT), which may be applied in the future at the applicable rate.
2.2 All charges must be paid in cleared funds by The Client before the hire starts. If payment is not made in cleared funds by the start date, the Agent will refuse access to the Location and the license will be invalid.
2.3 International Clients (outside of the UK) must pay 14 days in advance of the location hire.
2.4 Production Charges & Overtime: Production fees are subject to change at the Agent's discretion. Any overtime charges must be clearly stated by the Location, agreed upon in advance to be reflected in the hire agreement, and paid within 48 hours of the hire end.
2.5 Cancellation Policy: If the Client cancels the hire less than fourteen days before the start date, the full location hire fee and any other agreed charges are payable. For last-minute bookings, payment must be cleared immediately and any cancellations are non-refundable.
3. INTELLECTUAL PROPERTY & SITE USE
3.1 A Beautiful Place To Get Lost LTD will change the property's official name on the listing to protect its identity and prevent the Client from using the library as a database to negotiate directly with the venue.
3.2 Website Copyright: A Beautiful Place To Get Lost LTD holds the copyright to the materials on this website. Commercial use, reproduction, or duplication of any portion of the website is strictly prohibited.
3.3 Indemnity: The Client indemnifies the Agent against all claims, proceedings, costs, and expenses brought against the Agent for actual or alleged infringement of a third party’s Intellectual Property Rights arising out of the performance of the Contract by the Client.
4. CLIENT WARRANTIES & LIABILITY
4.1 Property images may not fully represent the property; areas, measurements, and distances are approximate. It is the Client's sole responsibility to inspect the Location and determine its suitability.
4.2 The Client must obtain all necessary insurance, risk assessments, permissions, and permits before commencing the Shoot or Event.
4.3 The Agent is not liable for any loss, damage, costs, or claims arising from incomplete or inaccurate Input Material provided by the Client.
5. HEALTH, SAFETY & PERSONNEL
5.1 While on the Owner's Premises, the Client must comply with all health and safety measures implemented by the Owner, as well as the Health and Safety at Work etc. Act 1974.
5.2 The Client agrees to submit any personnel or sub-clients to the Owner's security vetting procedures if required. The Owner reserves the executive right to refuse admission to individuals whose presence is deemed undesirable.
5.3 The Client must ensure that its employees, consultants, and sub-contractors do not unlawfully discriminate under any discrimination laws and regulations.
6. CANCELLATION & BREACH OF CONTRACT
6.1 The Agent/Owner reserves the right to terminate the Contract immediately by written notice if the Client fails to pay any sum due in cleared funds prior to the first day of hire, or if the Client provides materially inaccurate or misleading facts.
6.2 Owner's Right to Cancel: The Owner must provide as much notice as possible, and the Owner and Client agree to indemnify the Agent against any losses arising from an Owner-initiated cancellation.
7. FORCE MAJEURE
Neither Party is liable for breaches arising from circumstances beyond their control (e.g., fire, flood, sabotage, strikes, wars, terrorism, government actions). If a force majeure event occurs, the Owner should promptly inform the Agent.
8. CONTENT USAGE AND RIGHTS
All original content created by A BEAUTIFUL PLACE TO GET LOST LTD remains the property of the agency. Clients are welcome to share this content on their promotional channels, including social media, provided that full credit is given to A BEAUTIFUL PLACE TO GET LOST. Use of original materials beyond promotional sharing requires a private rights purchase discussion.
9. LAW AND JURISDICTION
The Contract is governed by English law and subject to the exclusive jurisdiction of the English and Welsh courts.
